Terms of Service.

These Terms of Service (“Terms”) govern your use of www.cncpoolco.com (the “Site”), operated by CnC Pool Construction LLC (“CnC Pool Construction,” “we,” or “us”). By accessing or using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Site.

The Site is an informational and lead-intake website for CnC Pool Construction’s pool design, construction, remodel, and spa services in Riverside County and San Bernardino County, California. It allows you to learn about our services, request a consultation, and explore design ideas. The Site is not itself a pool-construction service, an engineering document, or a binding offer.

You must be at least 18 years old and have the legal authority to enter into a contract on behalf of yourself (or the property owner you represent) to submit a project request through the Site.

Information on the Site, including cost ranges, timelines, and feature descriptions, is provided for general planning purposes only. Any specific number you receive, whether a ballpark estimate from our calculator, a verbal range during a consultation, or a written estimate, does not become a binding agreement until both parties sign a written construction contract for your specific project.

Until that contract is signed, no purchase, work obligation, or financial commitment has been created on either side. Final pricing depends on the actual conditions of your lot, permitting, soil, your selections, and prevailing material costs at the time of contract.

We make a good-faith effort to keep the Site accurate and current, but we do not warrant that all content is complete, current, or free of errors. Pool features, materials, supplier catalogs, and pricing change over time. If something on the Site contradicts a written estimate you receive from us, the written estimate controls.

Photographs on the Site are illustrative of the types of pools, finishes, and features we build. Unless explicitly identified as a project completed by CnC Pool Construction, images may include reference photography, style representations, or images licensed for illustrative use. The pool we build for you will be designed for your lot and your selections; it will not be a copy of any image on the Site.

The Site, including its text, graphics, logos, layout, and design, is owned by CnC Pool Construction or used under license. You may view and print pages for personal, non-commercial use, and you may share links to public pages. Beyond that, please do not reproduce, republish, or redistribute Site content without our prior written permission.

When you submit information through the quote form or any other contact channel, you confirm that the information is accurate to the best of your knowledge and that you have the right to share it. Your information is handled according to our Privacy Policy.

Please do not submit information through the Site that is sensitive, confidential, or regulated (such as financial-account numbers, government IDs, or medical information). If we need that kind of information for a contract, we will collect it through a secure channel.

If you provide your mobile number and agree to receive text messages, we may send you conversational and informational text messages about a project we are quoting or building: appointment confirmations, crew arrival windows, inspection scheduling, milestone updates, and replies to questions you send us. We do not send marketing or promotional text messages.

• Consent is optional, agreeing to receive text messages is never a condition of buying anything from us. You can decline and still get a quote and have your project built.
• Message frequency varies, on average 10-20 messages per month. It depends on where your project stands: more during active construction, rarely otherwise.
• Message and data rates may apply, according to the plan you have with your mobile carrier.
• Stopping messages, reply STOP to any message to opt out and you will get one confirmation and nothing further. Reply HELP for help, or call (951) 499-5579.
• Delivery is not guaranteed, mobile carriers are not liable for delayed or undelivered messages. Please don’t rely on text for anything time-critical or safety-related.

Text messages are for convenience and coordination only. They are not a substitute for the signed construction contract, and no text message changes the scope, price, or schedule of your project, any change must be made in a written change order signed by both parties. How we handle your number is described in our Privacy Policy.

The Site links to third-party websites (lender partners, supplier websites, social media, review platforms). We do not control those sites and are not responsible for their content, practices, or policies. Following a link to a third-party site is at your own risk and subject to that site’s terms.

The Site is provided “as is” and “as available.” Except as required by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, with respect to your use of the Site itself.

This disclaimer applies to the Site only. The warranties on actual pool-construction services we perform under a signed contract are described in the contract and on our Warranty page.

Information on the Site is general guidance and does not constitute engineering, legal, financial, or tax advice. Pool construction always requires site-specific engineering and permitting; do not rely on Site content for those decisions.

To the fullest extent permitted by California law, CnC Pool Construction is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site itself, including loss of data, lost profits, or business interruption, regardless of legal theory, even if we have been advised of the possibility. This limitation does not apply to any liability that cannot be limited or excluded by California law, and it does not apply to obligations under a signed construction contract.

You agree to indemnify and hold harmless CnC Pool Construction and its owners, employees, and contractors from claims, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or your violation of these Terms.

These Terms are governed by the laws of the State of California, without regard to conflict of laws principles. Any dispute arising from your use of the Site that is not otherwise resolved between us shall be brought in the state or federal courts located in Riverside County, California, and you consent to the personal jurisdiction of those courts.

If you have a concern with the Site or anything we’ve done, we ask that you contact us first, either by phone at (951) 499-5579 or through our contact form, so we have a chance to make it right. We try to resolve concerns quickly and in good faith.

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full effect. These Terms, together with our Privacy Policy and any signed construction contract, are the entire agreement between you and CnC Pool Construction regarding your use of the Site.

We may update these Terms from time to time. The “Effective date” at the top reflects the most recent revision. Continuing to use the Site after a change means you accept the revised Terms.
